E-Discovery / E-Disclosure

CCL-Forensics’ experience in data collection and filtering is backed up by our ability to offer e-discovery and e-disclosure services. We work with a trusted name in the e-discovery and document management industry to provide an intuitive data viewing platform.

An 8GB memory stick, full of Microsoft Word documents – all three pages long – would, if printed out, require almost 2.5 million sheets of A4. Stacked on top of each other, this would measure ¼ km in height.

Q: Can you print out all the documents on this computer – we require them for a litigation case?
A: Certainly.  Where would you like the fleet of lorries to deliver it to?

This is very much an “in-joke” between legal professionals who understand e-discovery (e-disclosure) and those who don’t.

Dealing with case documents as part of a disclosure exercise can be a mammoth task - especially if that documentation is in paper format. As the vast majority of business documentation is created, stored and accessed electronically, it makes sense that it remains in its electronic format during the legal review process.

Given that 1 gigabyte of electronically stored information (ESI) can represent 100,000 pages of email, electronic disclosure is a convenient, easy-to-use and efficient method of reviewing documents, enabling access by multiple reviewers using an intuitive online viewing tool. It allows documents to be marked as responsive or privileged, highlighted, and redacted - as well as enabling email threads to be analysed quickly and efficiently.

CCL-Forensics works with a respected partner in this field and is able to offer a full electronic disclosure service including data collection, document processing, filtering, de-duplication, hosting & online review.

This starts with answering the question, What will need to be searched? This, typically involves a combination of...

  • Email
  • Personal computers
  • File servers
  • Archives
  • Backups (tapes)
  • Databases & finance systems
  • Voice recording
  • Removable media
  • Mobile phones

...which is summarised in a data map report, produced following discussions with the client’s IT department.

Targetted data collection is then carried out forensically by our team of highly trained digital forensic analysts using tools and techniques that ensure no changes are made to the original media.

Prior to the Case Management Conference, discussions will be held to discuss relevant search criteria including key words, assessment of document volume, proportionality and conceptual searching. A timetable for disclosure is agreed as are the resources required for review.

Document review (for both electronic and paper documents) is provided securely using an online platform, which features flexible search capability (boolean and conceptual) in multiple languages.

This system enables you to monitor review progress (including progress by reviewer and percentage of total documents reviewed)
